VILLAGE OF DECATUR REGULAR BOARD MEETING October 9th, 2025 @ 4:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, AND DECATUR EXPRESS. The Village Board reserves the right to go into executive session for matters appropriate under the Nebraska Open Meetings Act. Guests signing in were: Elemer Armstrong, William Mueller, Connie Jelsma, Peggy Haeffner, Judy Connealy. Guests not signing in were Ray & Julie Metcalf. 1) REGULAR MEETING CALLED TO ORDER BY CHAIRMAN ANDERSON. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE MEETING: Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 3) AGENDA AND MINUTES OF THE PREVIOUS MONTH'S MEETING RECEIVED: Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 4) APPROVAL AND/OR CORRECTION AND SUSPENDED READING OF THE PREVIOUS MONTH MINUTES. There were none. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 5) REPORTS OF OFFICERS, BOARDS AND OR COMMITTEES: 1) Police: Monthly Report A. Received the Police Report. B. The Board discussed advertising for a full-time officer after the 1st of the year. We have lost one part-time officer for a year. 2) Lights: Monthly Report A. Burt County Public Power Rate Adjustment. Total of a 1% increase after the first of the year. The Board will continue to monitor. 3) Water & Sewer: Monthly Report A. Water Loss Report. 9.65 %. Anderson is wondering if there is another company that can help us find the water leaks? McCullock is wondering if the water line on North 4th Avenue is leaking again. McCullock will have Larry check on this. Troutman stated that the UV lights have been removed from the sewer plant. The insulation has to be replaced on the water line on the bridge. B. Skylar and Mike are registered for Sewer Class in Norfolk on November 3rd through the 5th, and November 17th and 18th. They will take the test on November 19th. 4) Parks: Monthly Report A. September 2025 income-$3,978.23: August 2025 income was $12,557.46. The splash pad has been closed for the season. The restrooms and boat dock will be removed after Halloween. 5) Streets: Monthly Report A. October Highway Allocation-$$7,163.20 and $1,452.04 Motor Vehicle Fees. Hightree will contact TR Harris to see when they are able to start on the replacement of concrete. 6) Sears Center: Monthly Report A. We are working with insurance to get the roof fixed. A United Door worked on the front doors at the Sears Center. The invoice stated that the doors were not in in operating order. The Clerk will call A United to see if this was a misprint on the invoice. 7) City Hall A. There is a window leaking in the Village office, and it is leaking around the chimney. It only seems to leak when the wind blows with the rain. Hightree will talk with Boden Construction to see if they will take a look at it. B. Property Cleanup Update 481 West 10th Street, 340 East 8th Street, 410 West 9th Street, 421 West 9th Street, 430 West 9th Street, 1502 Riverview Drive, 340 East 9th Street, 481 West 12th Street, 1302 South 2nd Avenue, 212 North 4th Avenue, 540 West 10th Street, 653 North 5th Avenue, 932 South 5th Avenue. 6) OLD BUSINESS 1. Fish Cleaning Station Update, and Agreement between Nebraska Game & parks and the Village of Decatur. Hightree made a motion to sign the agreement with the Nebraska Game & Parks Commission for the purchase of the Barracuda Fish Cleaning Station (Model III 6096), and the Nebraska Game & Parks will pay ½ of the cost in the amount of $34,006.50, the Carson Family has agreed to pay the other 1/2.. McCullock seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 2. Update on the Sears Center Roof Claim. The Village is working on the claim with the insurance company. 3. Massage Therapist Monthly Lease Cost. Anderson and Troutman meant with Martha Lucia Guerrero at the Sears Center. She is very interested in coming to the Sears Center to do massages. 7) NEW BUSINESS 1. A. William Mueller- William Mueller-Planting Tree on the old Museum Property, between the sidewalk and the curb. William came to the table to discuss the plans for the tree planting. The Board discussed different long-lasting trees that the Museum might consider. Troutman made a motion to allow the Museum to plant a tree between the curb and the sidewalk. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Motion Carries. B. Village Website William is making a website for the Museum and noticed that the Village website is outdated. He asked who did the Village Website? NPPD is who did the website. They do assist us with updates. He asked if the Museum could link the Museum website with the Village website. All of the board members were in agreeance with this. 2. Public Hearing on the One-& Six-Year Street Plan. Troutman made a motion to open the Public Hearing on the One-and-Six Year Street Plan. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Anderson asked if there were any questions from the audience or board members? He did state that the Village asked for bids from asphalt companies to replace the lower portion of 5th Avenue, but we received no bids. The Village will have to wait until spring to get this fixed. This is on the One-and Six Year Street Plan. Troutman stated that 2nd Avenue is not on the Plan. Anderson stated that 2nd Avenue is considered maintenance. Kirschenman stated why they do we not add the lower portion of 5th Avenue and the rest of 5th Avenue down West 8th Street to the Highway together? He stated that it seemed to a lot of money for the lower part of 5th Avenue. Anderson and Troutman stated that 5th Avenue is one of the wider streets and will have to be totally milled off and replaced. The figures that the Engineer put on the Street Plan are what he is figuring it will cost. There were no more questions. Troutman made a motion to close the Public Hearing on the One-& Six-Year Street Plan. McCullock seconded the motion. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, Troutman-yes, McCullock-yes. The Public Hearing is closed. Troutman made a motion to approve the 2025-2026 One-and-Six Year Street Plan. Resolution #210 Adopting the One-& Six-Year Street Plan Resolution #210 Adopting the One-& Six-Year Street Plan WHEREAS: State of Nebraska Statutes, sections, 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classification and Standards; and WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body of the municipality authorizing the signing of the certification form. Be it Resolved that the Village Board Chairperson of Decatur is hereby authorized to sign the attached Municipal Annual Certification for Program Compliance form. Troutman made a motion to adopt Resolution #210 McCullock seconded the motion. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, Troutman-yes, McCullock-yes. Motion Carries. Discussion and Consideration of Motion for Acceptance of Partial Payment of Existing Lien Due to Demolition @ Parcel 111004400 in Exchange for Full Release. A person offered the Village ½ of the lien that was placed on this parcel, due to the Village cleaning the property and taking down the house. Hightree made a motion to accept the partial payment of $3,447.50 for the lien that was placed on the property. McCullock seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, Troutman-yes, Hightree-yes, McCullock-yes. 5. Andrew Mitchell-Barking Dogs, Dogs at Large, Dangerous Dogs. Andrew did not attend the meeting. Connie Jelsma did come to the table to address her dog, that Andrew had filed a complaint about. She is putting up a fence to try and take care of this issue, and the dog is on a leash at all times. There has to be two complaints filed. 6. Chad Marsh would like to purchase the can crusher from the Recycling Center. The Village gave $5,290.00 for the can crusher with a conveyor belt. Kirschenman made a motion to sell the can crusher for ½ of what the Village gave for it. Hightree seconded the motion. Roll Call: Anderson-yes, McCullock-yes, Troutman-yes, Kirschenman-yes, Hightree-yes. 7. Ann Chytka Resigned from the LB840 Application Committee, The Village has an opening if anyone is interested. Troutman made a motion to accept Ann Chytka’s resignation from the LB840 Application Committee. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Anderson stated that two of the names that came up were Rene Stammer, Lila Hadcock. Peggy Haeffner is on that committee, she suggested Tim Slaughter. 8. Power Manager Training is set for November 3-6, 2025. Two full days November 3rd and 4th and 2-½ days November 5th and 6th. The office will be open after the two half days of training. The ask if we may be closed on those days? (See attached email) Troutman made a motion to close during the training for our new system. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 9. John Maryott Resignation from the Maple Villa Board. Troutman made a motion to accept John Maryott’s resignation from the Maple Villa Board. McCullock seconded the motion. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, Troutman-yes, McCullock-yes. 10. Joe Malloy Maple Villa Board. Troutman made a motion to appoint Joe Malloy to the Maple Villa Board. Kirschenman seconded the motion. Roll Call: Anderson-yes, Hightree-yes, McCullock-yes, Troutman-yes, Kirschenman-yes. 11. Board Approval for Signal to start writing tickets. Troutman made a motion to approve Signal 88 to start writing tickets to residents that are not cleaning up their properties. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 12. Bid from Black Diamond for Monitor in City Office. The Village did not receive a bid. Will add back on the November agenda. 13. Quote for Radar Speed Sign on Highway. (Missouri River Bridge) The speed sign on the Missouri River Bridge has lights that are not working. The Clerk contacted the company that it was purchased from and they no longer able to be fixed. The company gave a quote for a new speed sign that has more capabilities than the one we have now. $4,037.00 is the quote for the new speed sign. Troutman made a motion to purchase the new speed sign for $4,037.00 and split the cost between police and streets. Kirschenman seconded the motion. Roll Call: Anderson-yes, Hightree-yes, McCullock-yes, Troutman-yes, Kirschenman-yes. 14. Judy and Peggy Pavillion Proposal. Judy and Peggy came to the table to discuss the pavilion that the Carson Family wants to donate to Beck Park. The two sites they chose were on the the east side of the big shelter and the other location is between the splash pad and the playground and have concrete adjoin each of them. The Board explained to them that this is not in the budget. The clerk will check with the auditor to see if this can be done in this new fiscal year. 15. Justin Punke-Building Permit He was not able to attend the meeting, will put on the November agenda. There was much discussion on this item. Hightree made a motion to have a survey done. Troutman seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Hightree-yes, Troutman-yes. Motion Carries. 8) CORRESPONDENCE AND ANNOUNCEMENTS 1. Next Regular Board Meeting, Thursday, November 13th, 2025 at 4:30 PM. 2. Thank you card from the United Methodist Church and Y.U.M.S. for the new remodeled kitchen in the basement. 3. Any Questions from the Audience? Julie Metcalf asked if the door on the dumpster corral could be fixed, there are nails sticking out of it? The Board stated that the maintenance crew would look at it. 9) APPROPRIATIONS AND CONSIDERATION OF THE CLAIMS: 1) Claims preapproved by McCullock and Troutman. 2) Motion to Approve the Claims as submitted. Troutman made a motion to approve the claims as submitted, excluding A United door until we find out if the door is working properly. Hightree seconded the motion.
