VILLAGE OF DECATUR REGULAR BOARD MEETING November 13th, 2025 @ 4:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, AND DECATUR EXPRESS. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE MEETING: All were present. 3) AGENDA AND MINUTES OF THE PREVIOUS MONTH'S MEETING RECEIVED: Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 4) APPROVAL AND/OR CORRECTION AND SUSPENDED READING OF THE PREVIOUS MONTH MINUTES. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 5) REPORTS OF OFFICERS, BOARDS AND OR COMMITTEES: 1) Police: Monthly Report Officer Sparks gave the police report to the board. They discussed getting a new printer for the police office. We are waiting to see if Eakes can get the Toughbook computer to print to the printer in the Clerk’s office. Anderson asked Officer Sparks to price printers. The patrol car needs a new fire extinguisher; they used the one that was in the patrol car. Officer Sparks contacted the NDOT about putting a four-way stop at the intersection of 7thStreet and Broadway. They suggested upping the speed limit to 35MPH. The Board does not want to do this. 2)Lights: Monthly Report One meter was pulled for non-payment, was paid and power was restored. There is an electric pole and transformer that will need replaced on East 12th Street. Kirschenman asked why there was a power outage on Saturday. Hightree stated that a Squirrel got in a fuse. 3) Water & Sewer: Monthly Report A) Water Loss Report.9.65 % 4) Parks: Monthly Report. A) October 2025 income was $955.02. The old shower house is still open for hunters. The boat dock is still in, it has been nice weather. 5) Streets: Monthly Report: November Hwy Allocation - $6,960.12. Sales Tax for August 2025 paid in October 2025 - $9,869.36, $3,723.60 to LB840. T& R Harris is here working on the patch jobs. Kirschenman made a motion to add east 12th street to the patch work that T&R Harris is doing in the amount of $2,368.00. Hightree seconded the motion. Roll Call: Anderson-yes, McCullock-yes, Troutman-yes, Kirschenman-yes, Hightree-yes. The Clerk stated that the Auditors have been here this week and they are very impressed on how the Board has been handling the LB840 money to help businesses. 6) Sears Center: Monthly Report Working with Contractor, and Adjuster for Insurance Roof Claim. The insurance adjustor was here yesterday looking at the Sears Center. He noticed the pillars on the front side of the building were moving. He stated that this is not covered under insurance, he thinks the ground is moving. The board discussed possibly calling Thrasher to see if they could possibly do something to fix it. Judy Connealy came to the table; she will find out how much is in the fund. 7) City Hall: Monthly Report After the Methodist Church Bazaar, the Village needs to split up the circuits on the counter for Serving, Hightree will speak to the contractor about the electrical issue. Add more sound proofing to the walls and ceiling. 8) Property Cleanup Update: The Village is working with Signal and our attorney on ways to get properties cleaned up. 481 West 10th Street, 481 West 12th Street, 340 East 9th Street, 340 East 8th Street, 540 West 10th Street, 212 North 4th Avenue. 6) OLD BUSINESS: 1. Judy Connealy and Peggy Haeffner-Pavillion size and budget information. Anderson stated that we can not amend our budget unless it is an emergency. We will not be able to do the pavilion this year. Mat Munderloh (Village Attorney) would be willing to discuss other options for the pavilion. Judy stated that the project would be around a $300,000.00 project, due to a change in the plans.We need the figures for the budget by June 2026. Once the order is placed it will take 3-4 months before it is delivered. Judy asked what size recommendation for the pavilion? The Board suggested the 48’ pavilion between the playground and the splash pad. Anderson stated that the board should let the donor decide on the size, because they are being so gracious with the donation. The other board members agreed with Anderson’s recommendation. Judy and Peggy asked if Wayne Hightree could be a part of the committee for Beck-Busse Park project, Wayne accepted. Anderson suggested that McCullock should be on this committee, due to being Park Commissioner. 2. Fish Cleaning Station is ordered. Waiting for it to arrive. 3. Justin Punke-Building Permit. Justin came to the table to discuss the survey that was done on 13th Street. He brought pictures for the Board to look at. The survey markers are very close to his front door. The Board need to get some legal advice from the Village attorney. Justin asked who is responsible for the kids that fly up and down the hill and fly off the retaining wall and gets killed. We will keep Justin informed about what is happening. Will put Justin back on the December agenda. 4. Bid from Black Diamond for a monitor in the Clerk’s Office. Nothing received from Jason. 5. LB840 Application Committee. Troutman made a motion to approve Renee Stammer as a member of the LB840 Application Committee. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 7) NEW BUSINESS 1. Shane Wimer-Feedback and Set Expectations. Shane came to the table to discuss the six-month review with the Board. Troutman told Shane they were doing phenomenal, but what is our next steps? Taking the next step with the Village Attorney. Shane stated that we have enough proof that we have given people time, but it is time that a few need to move forward with legal steps. The Clerk stated that the Board is worried about the threats that have been made. The Attorney stated that we need to have law enforcement present with those residents. In the long run the land owner is legally responsible. The Board has no say in whom Signal chooses for property cleanups. Signal was hired by the Village and they find the properties on their own. 2. Whit Brummond Proposal. Whit is using two office spaces at the Sears Center for his Chiropractic business one timeper week. He is very appreciative of the Board giving him the opportunity to use the space. He has 18 new patients. He would like to sign the years lease with the Village. He would like to stay around the $300.00 per month. He cleans his own area. Kirschenman made a motion to charge $275.00 a month, and Whit will do his own cleaning. Hightree seconded the motion. Roll Call: Anderson-yes, McCullock-yes, Troutman-yes, Kirschenman-yes, Hightree-yes. 3. Jolene Troutman-Baseball Association. Jolene Troutman and Kaitlyn Klatt came to the table to ask the Boards permission to start a Ball Association in Decatur. Troutman made a motion to allow Jolene and Kaitlyn to form a Decatur Ball Association. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. They will come back when they have more information on grants to improve the ball field. 4. Matt Munderloh -Transition to Goosman Law Firm. Troutman made a motion to stay with Matt Munderloh and Goosman Law. McCullock seconded the motion. Roll Call: Hightree-yes, Kirschenman-yes, Anderson-yes, Troutman-yes, McCullock-yes. 5. Day After Thanksgiving open or closed? Floating Holiday is in the Handbook, so the Board stated the Office could be closed the Day after Thanksgiving. 6. Public Hearing – Comprehensive Development Plan. Troutman made a motion to open the Public Hearing on the Village of Decatur Comprehensive Development Plan 2035. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Anderson asked if there were any questions on the Comprehensive Plan Development Plan 2035? Jim Judt came to the table. He wants to buy a copy of the Comprehensive Plan. He wants to look at it before he buys it. The Clerk told Jim that the it does not have the zoning regulations in it; the Planning Commission is still working on that part of the book. He stated that the rest of 13th street still exists up to 5th Avenue. The Board stated it does. There were no other questions. Troutman made a motion to close the Public Hearing on the Comprehensive Development Plan 2035. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Motion Carries. The Public Hearing is closed. 7. Resolution # 213 Adopting a Comprehensive Development Plan. The Clerk read Resolution #213. Troutman made a motion to adopt Resolution #213 Adopting a Comprehensive Plan 2035. McCullock seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, Hightree-yes, Troutman-yes, McCullock-yes. The Resolution and Comprehensive Development Plan 2035 are available to view at the Village Office. 8. Resolution #214 Adoption of the Blight & Substandard Determination Study. The Clerk read Resolution #214 Troutman made a motion to adopt Resolution # 214 Adoption of the Blight & Substandard Determination Study. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. The Resolution and the Blight & Substandard Determination Study are available at the Village Office. 9. Resolution #215 Approving a General Development Law. McCullock read the Resolution. Troutman made a motion to adopt Resolution #215 Approving a General Development Law. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. The Resolution is available at the Village office. 10. Two- & Ten-Year Master Plan for Water. The Board went through the Two- & Ten-Year Master Plan for Water. Troutman made a motion to adopt the Two- & Ten-Year Master Plan for Water. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. The Master Plan is available at the Village Office. 11. Does the Board want to Amend the 2025-2026 Budget for Pavillion? The Board does not want to amend the budget; it has to be an emergency to amend. 12. 4-Way Stop on 7th and Broadway. Officer Sparks checked with the State, there would have to be a study done, and they would probably raise the speed limit. 13. LB840 Audit Committee Vacancy. McCullock made a motion to appoint Jackie Anderson to the LB840 Audit Committee. Troutman seconded the motion. Roll Call: Anderson-abstain, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 14. Jeff Meyer Resignation Janitorial/Maintenance. Hightree made a motion to accept Jeff Meyers resignation. Troutman seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Hightree-yes, Troutman-yes. 15. Hiring Part-time Janitorial and Light Maintenance Bree Sparks-Freemont. Hightree made a motion to hire Bree Sparks-Freemont for Part-time Janitorial and Light Maintenance. Kirschenman seconded the motion. Roll Call: Anderson-yes, McCullock-yes, Troutman-yes, Hightree-yes, Kirschenman-yes. 16. King Disposal starting Recycling, provide trash cans and they can recycle old trash cans. Michael Taylor came to the table to discuss recycling everyone’s old trash cans and providing the same trash cans for everyone, and starting a recycling program. He thought it would be around $28.00 for a 96 gallon can for trash and another can 96 gallon can for the recycling. Recycling would be picked up every other week. They would come up with a list for things that can be picked up for recycling. They are meeting with the tribe tomorrow and will know more after that meeting. They would not be starting until February of 2026. 17. Steve and Maddie Brown-Move in 2-32x76 stick built buildings to make 4-duplex apartments each would be around 1200 square feet. Steve and Maddie came to the table to discuss their plans for 233 North Avenue. The house that is there is not in very good shape. The Board was in agreement that they needed to get this property surveyed so they know exactly where their property lines are located. 18. Discuss Utility Rates. Anderson stated according to our financial statements we need to make some changes. McCullock stated this is going to have to be a process, we can not recoup everything in one year.There was much discussion on the rates. The Resolutions will be on the December 2025 Agenda. 8) CORRESPONDENCE AND ANNOUNCEMENTS 1.Next Regular Board Meeting Thursday, December 11th, 2025 at 4:30 PM. 2. Are there any questions or comments from the audience? Rod Nelson asked about the power line at the Lutheran Church, Hightree is still working on this.
