VILLAGE OF DECATUR REGULAR BOARD MEETING May 8th, 2025 @ 4:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, AND DECATUR EXPRESS. The Village Board reserves the right to go into executive session for matters appropriate under the Nebraska Open Meetings Act. The guest signing in were: Chad Reiner (Williams & Company), Stan Teutsch, Bill Mueller, Nico Hardeman, Kay Kellogg (KH Insurance), Jenny Penny (for Cole & Kiley Worley), Elmer Armstrong, Carl Raue. Guests not signing in were: Matthew Munderloh, Ray and Julie Metcalf, Teri Teutsch. 1) REGULAR MEETING CALLED TO ORDER BY CHAIRMAN ANDERSON. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE MEETING: Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 3) AGENDA AND MINUTES OF THE PREVIOUS MONTH'S MEETING RECEIVED: Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 4) APPROVAL AND/OR CORRECTION AND SUSPENDED READING OF THE PREVIOUS MONTH MINUTES. There were none. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, McCullock-yes, Troutman-yes. 5) REPORTS OF OFFICERS, BOARDS AND OR COMMITTEES: 1. Police: Monthly Report No Police Report. 2. Lights: Monthly Report There are two poles that are still down, but will be fixed soon. Altec was here to inspect the basket truck. 3. Water & Sewer: Monthly Report Water loss was 10%. The UV disinfection lights have been put in at the sewer plant. Michael Parsons resigned from the Village on Tuesday, May 5th. The was no resignation letter, it was done per phone call. Skylar McMullin will take his sewer certification test at the end of the month. Parks: Monthly Report A. April 2025 Income of $16,358.81. B. The park is still on the list for red rock. C. The fish cleaning station is still not working, it gets abused. The guys have found pliers and other things in it. Hightree mentioned that they have a new grinder motor, it is called the Barracuda. The board will check into this grinder. 4. Streets: Monthly Report A. May Highway Allocation-$6,241.79. B. April Motor Vehicle Fees $1,494.19. C. March Municipal Equalization $1,590.29. D. February 2025 Sales Tax received in April Total $12,930.26, $5,697.85 to LB840. Kirschenman and Hightree met with Garrett Johnson to look at West 8th Street. To fix the drainage problem he recommended larger tubes on the top and go smaller down the hill and make it flat at the bottom, and then plant brome or oats. This is to help hold the bank on both sides. Anderson stated that we need to get in touch with Knife River to have them repair South 5th Avenue between Nick French and Steve Kellogg. 5. Sears Center: Monthly Report The sign is up at the Sears Center. Troutman changed the electrical part to underground. Our maintenance crew did the trenching and replaced the concrete. 6. Community Center Building Report A. Sump Pump Replacement Thrasher due to age. The clerk will get this scheduled. Troutman made a motion to replace the sump pump in the basement. Basement remodel is almost finished, Acoustic Panels have been delivered. 6) OLD BUSINESS: 1.Matthew Munderloh-Legal Counsel. Troutman made a motion to go into Executive Session at 4:41 PM for discussion with Attorney to preserve the Attorney-Client Privilege. Hightree seconded the motion. Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Motion Carries. 2. John Sparks Resignation Letter. Hightree made a motion to accept John Sprks resignation. Kirschenman seconded the motion. Roll Call: Anderson-yes, McCullock-yes, Troutman-yes, Hightree-yes, Kirschenman-yes. Motion Carries. 3. Sergeant Hedlund raise for taking position. Per Village Attorney the Village has to have a Chief. Troutman made a motion to hire Officer Hedlund as interim police chief. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Motion Carries. 4. Per Village Attorney Rescind Bids for Concrete Work. This is due to the bids being over the Village Ordinance of a maximum of $20,000.00 without a bid notice. State Statute states we can raise to $30,000.00 without a bid notice. Troutman made a motion to rescind the bid award from the April 10th 2025 meeting. Hightree-seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 7) NEW BUSINESS 1. Splash Pad Hours. Jennifer Penny came to the table and explained to the board that the splash pad only uses a pivot full of water for the summer. Hightree stated that last year we had one well out of commission last year, that is why we had limited hours last year. Hightree made a motion to open Splash Pad on May 23rd, the hours will be 1:00 PM to 8:00 PM daily. Will continue to monitor drought conditions. McCullock seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, Troutman-yes, Hightree-yes, McCullock-yes. 2. Broadway Brothers-Close Street for Riverfront Days, June 13, 2025. Kay Kellogg came to the table to represent Broadway Brothers. They are asking permission to close off the west half of east 8th street for a Street Dance. Troutman made a motion to allow Broadway Brothers to close the west half of east 8th street for a street dance, with the stipulation to have the fence down by 10:00 AM on Saturday morning. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 3. KH Insurance-Commercial and Worker’s Comp Insurance. The board wanted to look through the KH Insurance Bid, and the bid from Traveler’s (Workman’s Comp Insurance), the board decided to have a special meeting on May 29, 2025 at 4:30 PM, so they have time to look through the bids. 4. LARM- Commercial and Worker’s Comp Insurance Bid. The board wanted to look through the LARM bid for Workman’s Comp Insurance and Commercial Insurance. The board decided to have a special meeting on May 29, 2025 at 4:30 PM, so they have time to look through the bids. 5. Audit Report Chad Regnier came to the table to go through the audit report. Troutman made a motion to approve the Audit Report. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. 6. Lot 6, Block 22, Parcel # 110904100. This property was sold by the County while the Village had a lien on the property. Anderson suggested giving up the property to get it back on the tax rolls, and the people that purchased it have been cleaning up the trees and overgrowth. Troutman suggested asking for a portion of the lien for the property. None of the board understands how the County could sell this. The Clerk will follow up with Matt Munderloh on this property. 7. Stanley Teutsch requesting payment for fixing driveway on South Second Avenue, damage from Contractor. Stan came to the table to discuss the bill for fixing his driveway. Troutman made a motion to pay the bill for the repairs to the driveway, if Stan Teutsch would sign a hold harmless agreement/release of damages with the Village as far as the driveway is concerned. Kirschenman seconded the motion. Roll Call: Anderson-yes, Hightree-yes, McCullock-yes, Troutman-yes, Kirschenman-yes. 8. Bill From Cass Plumbing and HVAC for Replacement of Sprinkler Line on South Second Avenue, cut by Contractor. Troutman made a motion to pay the Cass Plumbing bill if the Rickers will sign a hold harmless agreement/release of damages for the sprinkler system. Kirschenman seconded the motion. Roll Call: Anderson-yes, Hightree-yes, McCullock-yes, Troutman-yes, Kirschenman-yes. 9. Turn the One Mile Zoning Jurisdiction over to the County. This has to be presented to the Planning Commission first. The Board agreed that the Village will keep our one-mile zoning jurisdiction. Nico Hardeman came to the table and stated that his attorney told him that the zoning jurisdiction is a State Statue and we can not turn it over to the County. Anderson stated again that the Village is not giving the one-mile zoning jurisdiction to the County. 10. Job Applications-Part-time Custodial/Light Maintenance. Anderson stated that the board should pick the top three applications out of the five that we received and then schedule interviews. This is tabled until our May 29, 2025 special meeting at 4:30 PM. 11. Health Insurance Rates. Tabled until the June 10, 2025 meeting at 4:30 PM. Anderson stated the clerk should contact our insurance person to have him explain the insurance to the employees. 12. Ordinance #05-2025-Pertaining to Contracts and Purchases and Bidding and Other Requirements. ORDINANCE NO. 05-2025 AN ORDINANCE OF THE VILLAGE OF DECATUR, NEBRASKA, AMENDING CITY CODE SECTION 34.02, PERTAINING TO CONTRACTS AND PURCHASES AND BIDDING AND OTHER REQUIREMENTS; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM. Troutman made a motion to approve Ordinance #05-2025 Pertaining to Contracts and Purchases and Bidding and Other Requirements. Hightree seconded the motion. Troutman made a motion to adopt Resolution #204-Increase Capitalization Threshold. McCullock seconded the motion. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, Troutman-yes, McCullock-yes. 14. Bid Specs for Concrete Work. The Village has received the bid specs for the concrete work. The Bid Specs are available at the Village Office at 913 South Broadway, Decatur, NE 68020. 15. Pick 2-3 Planning Firms for Downtown Revitalization Grant. Anderson and the board suggested getting Garrett Johnson’s (Village Engineer) input on this. The Clerk will contact him tomorrow. 8) CORRESPONDENCE AND ANNOUNCEMENTS 1. Next Regular Board Meeting, Thursday, June 12th 2025 at 4:30 PM. 2. Weather permitting the dump will be open the 1st and 3rd weekends of each month. Saturday 8:00 AM to 12:00 PM Sunday 1:00 PM to 5:00 PM 3. Cleanup Day is May 17, 2025 from 8:00 AM 12:00 PM. 4. Are there any questions or comments from the audience? Elmer Armstrong came to the table. He asked if there had been any updates on the Nuisance & Abatement Process? Anderson stated it has just started; the company is here on Fridays driving through the town looking at all properties. Elmer asked if the board would be doing monthly Nuisance & Abatement updates on the agenda? We will do a report for the agenda. Elmer thanked the board for hiring a firm to do this work. Teri Teutsch came to the table to ask when Steve and Maddie Brown will be moving their building that is only a foot from the property line? Anderson stated we will be getting our Zoning person on this right away. They need to clean up the tree debris that they left. Anderson asked her to fill out a complaint form also. Jennifer Penny came back to the table to discuss an LB840 application from Cole and Kiley Worley to help with the down payment to purchase the Green Lantern. She is asking if they can be added to the special meeting agenda on May 29, 2025. They will be added to the May 29th special meeting agenda. Anderson stated nothing can be done until the application is filled out. Troutman asked if they were asking for a loan or a grant? A loan goes through our loan committee.
