VILLAGE OF DECATUR PUBLIC HEARING October 10th, 2024 @ 5:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, DECATUR EXPRESS, AND PUBLICIZED IN THE LYONS MIRROR SUN. There were no guests signing in. 1) PUBLIC HEARING CALLED TO ORDER BY CHAIRMAN SIECKE Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-absent. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE PUBLIC HEARING: Warren was not able to attend the meeting. Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes. 3) Public Hearing One- and Six-Year Street Improvement Plan. Troutman made a motion to open the Public Hearing on the One-& Six Year Street Plan. Kirschenman seconded the motion. Roll Call: Hightree-yes, Siecke-yes, Troutman-yes, Kirschenman-yes. The Board discussed the One and Six Street Plan, and there were no changes made. There were no guests present. Fiscal Year 2024-2025 Normal Maintenance. Six Year Plan Fiscal Year 2024/2025 to 2028/2029. 5th Avenue to 8th Street-Asphalt Paving/Overlay of 5th Avenue from 8th Street to 10th Street. 8th Street to 4th Avenue-Asphalt paving of 8th Street from 4th Avenue to 5th Avenue (Hwy to Cemetery Rd). Sacajawea Circle-Asphalt paving of Sacajawea Circle. Riverview Drive-Asphalt paving of Riverview Drive. Replacement of the Broadway Bridge. Siecke read Resolution # 198. Resolution #198 Signing of Municipal Annual Certification of Program Compliance 2024. WHEREAS: State of Nebraska Statutes, sections, 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classification and Standards; and WHERAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairman and shall include a copy of a Resolution of the governing body of the municipality authorizing the signing of the certification. BE IT RESOLVED that the Village Board Chairperson of Decatur, Nebraska is hereby authorized to sign the Municipal Annual Certification for Program Compliance. Troutman made a motion to authorize the Chairman to sign the Municipal Annual Certification of Program Compliance 2024. Hightree seconded the motion. RESOLUTION # 199 Whereas, Pursuant to LB 1302 of the 107th Legislature of the State of Nebraska, a public hearing was held by the Village of Decatur Board of Trustees for the purpose of drafting a One-and Six-Year Road Plan to designate specific road and bridge improvements for Decatur Village Roads. Whereas, Legal notice was published in the Lyons Mirror-Sun which is the legal newspaper in the County. Be it Further Resolved, The One- and Six-Year Road Plans were fully discussed by the Street Superintendent with the Village Board of Trustees and those present. Now Therefore Be It Resolved by the Decatur Village Board of Trustees that the One- & Six-Year Road Plans for Road Improvements in the Decatur Village be approved as presented by the Street Improvements in the Decatur Village be approved as presented by the Street Superintendent and as advertised and that such plans be ordered submitted to the State Highway Commission along with other evidence as required by the rules and regulations of the State Highway Commission. Village of Decatur, Nebraska Resolution #200 The following Resolution #200 was introduced by Board Member Troutman, who moved for its adoption, seconded by Board Member Hightree. WHEREAS, Garrett Johnson has prepared and the Village Clerk presented the One-and-Six Year Street Improvements for the Village of Decatur, Nebraska, and: WHEREAS, a Public Hearing was held on October 10, 2024 to present this plan, and all objections and recommendations in said plan were considered; THEREFORE, be it resolved by the Village Board of Decatur, Nebraska, that the plan and data as furnished and/or revised are hereby in all things accepted and adopted. Upon Roll Call as follows: Kirschenman-yes, Siecke-yes, Troutman-yes, Hightree-yes. WHEREUPON, the Resolution #200 was declared passed by the Village Board of Decatur on the 10th day of October, 2024, at Decatur, Nebraska.
