ORDINANCE NO. 2026-1 AN ORDINANCE OF THE VILLAGE OF CRAIG, NEBRASKA, DECLARING COMMERCIAL DOG BREEDING AND DOG KENNELS WITHIN THE CORPORATE LIMITS AND EXTRATERRITORIAL ZONING JURISDICTION OF THE VILLAGE A NUISANCE; PROVIDING A PROCEDURE FOR ABATEMENT THEREOF; PROHIBITING THE OWNERSHIP OF MORE THAN THREE (3) DOGS, AND DECLARING ANY DOG IN EXCESS OF THREE (3) OWNED BY ANY ONE PERSON A PUBLIC NUISANCE; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; REPEALING CONFLICTING ORDINANCES, RESOLUTIONS, SECTIONS, AND ACTIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS Nebraska law grants a municipality the power and authority by ordinance to define, regulate, suppress, and prevent nuisances, and to declare what shall constitute a nuisance, and to abate and remove the same within its corporate limits and its extraterritorial zoning jurisdiction, see Neb. Rev. Stat. ยง 18-1720; WHEREAS it is desirable and in the best interests of the Village and its residents that the Village define a nuisance to include commercial dog breeding and the maintenance of dog kennels anywhere within its corporate limits and extraterritorial zoning jurisdiction; and WHEREAS it is desirable and in the best interests of the Village and its residents that ownership of more than three (3) dogs at any one time be prohibited; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF CRAIG, NEBRASKA: Section 1. "Commercial dog breeding" defined. For the purposes of this Ordinance, "commercial dog breeding" shall mean the breeding or raising of dogs for resale or conveyance for profit, a fee, or other consideration of any kind. Section 2. "Kennel" defined. For the purposes of this Ordinance, "kennel" shall mean any lot or parcel of land or place where more than three (3) dogs, regardless of age, are confined, boarded, housed or cared for, regardless of purpose, including for pets, companionship, or breeding. Section 3. Kennel; declaration of nuisance. It is hereby declared to be a public nuisance to operate or maintain or permit to be operated or maintained a kennel within the corporate limits and extraterritorial zoning jurisdiction of the Village. Section 4. Commercial dog breeding; declaration of nuisance. It is hereby declared to be a public nuisance to engage in commercial dog breeding or permit commercial dog breeding within the corporate limits and extraterritorial zoning jurisdiction of the Village. Section 5. Maximum number of dogs permitted. It shall be unlawful for any person to own, keep, or harbor at any one time more than three (3.) dogs within the corporate limits and extraterritorial zoning jurisdiction of the Village. Any dog, in excess of three (3), owned by any person is hereby declared to be a public nuisance within the corporate limits and extraterritorial zoning jurisdiction of the Village. Section 6. Abatement procedure. Any kennel, commercial dog breeding, or any dog otherwise found in violation of this Ordinance shall be abated and removed according and pursuant to the procedures as generally provided in Chapter 91 of the Village1s municipal Code. Section 7. Penalty. In addition to any abatement or removal of the nuisance as provided herein, any person violating any provision of this Ordinance shall be deemed guilty of an offense and upon conviction thereof shall be fined in any sum not exceeding $500. A new violation shall be deemed to have been committed every 24 hours of failure to comply. Section 8. Severability. If any section, clause, provision or part of any section, clause, or provision of this Ordinance or the application thereof to any person or circumstance is held unconstitutional, such invalidity or unconstitutionality shall not affect the validity or application of any other section, provision, or part of this Ordinance. Section 9. Repeal of conflicting ordinances. Any other ordinance, .resolution, section, or action passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed. Section 10. Effective date. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
