Minutes of the Burt County Board of Supervisors The Burt Co. Board of Supervisors met June 26, 2026, in the Boardroom of the Burt Co. Courthouse in Tekamah, NE. Notice was given in the Burt Co. Independent (6-18-2026), on courthouse 1st floor bulletin board and on the Co. website; proof of publication is on file with Co. Clerk. The following members were present: Ted Connealy, Gary ‘Bird’ Swanson, Sam Titus, Carl Pearson, Jay W. Johnson, Paul Richards and Jeff Kutchera. The meeting opened with the pledge of allegiance at 9:00 A.M. Chairman Kutchera informed the public that the Open Meeting Act was posted. The agenda was approved. The minutes of the 6/10/2026 Bd of Supervisors and Bd of Equalization meetings were approved. The claims for June totaled $3,426,043.18 including $179,106.85 for payroll. During review, (1) one Roads fund claim #2606000114 for Oban Construction in the amount of $228,305.00 was denied. After pulling the claim, the Highway Superintendent submitted a replacement claim #2606000150 to the Burt Co. Treasurer that would move the $228,305.00 from the Roads Fund (0300) to the Capital Improvement Fund (2500) for future needs. The board then passed motion to approve all June claims. Board of Equalization (BOE) was held from 9:31-9:34 a.m. Overvalued/undervalued property changes were reviewed and action was taken to reduce value on (6) properties. Details can be found in the BOE board minutes online at www.burtCO..ne.gov. Co. owned building in Oakland: Unsafe building (PID #312808100). No updates structural engineering is no longer answering their questions. Budget Making Authority for FY2026-27: Sarah Freidel and Jeannette Blanc will do the County’s budget; Freidel will receive $2,500.00, Blanc will receive $1,500.00. Budget FY2025-26: TRANSFER OF BUDGET AUTHORITY RESOLUTION #2026-09 was adopted. WHEREAS, the following office budgets within the General Fund (0100) are over their budget authority: (602) Co. Clerk is over by $3251.80; (671) Jail budget is over by $42,582.48. AND WHEREAS, there is $313,491.50 of Budget Authority remaining in (970) Miscellaneous budget within the General Fund (0100). NOW THEREFORE BE IT RESOLVED by the Burt Co. Board of Supervisors that Budget Authority be transferred from (970) Miscellaneous budget within the General Fund to cover the above-mentioned office budget overages. DATED this 26th day of June 2026, at Tekamah, NE. Budget Amendment FY2025-2026: Public Hearing was held from 9:48 – 9:49 AM to take comments on the budget amendment TO RAISE BUDGET AUTHORITY FOR SHERIFF’S (2913)NEXTGEN/E911 FUND DUE TO PRIOR YEAR TRANSFER CORRECTIONS. There was no public comment. No additional tax monies are needed, the funds had the money for the transfers, the Public Service Commission advised about and provided the steps for the necessary corrections that had to be carried out; this “amendment” is merely a fix for budget “authority” of the FY 25-26 budget documents; the amendment was approved. Co. meeting agenda policy: Chairman Kutchera clarified for the record that agenda items are placed on the agenda by members of the Co. Board of Supervisors/Board of Equalization, or by Elected Co. Officials/Department Heads/Administration staff. ROADS: Ann Chytka, Highway Superintendent Vacating Public Road 203: Hwy Supt presented a study of Public Road No. 203; conclusion of the study is that the road serves no purpose as a road traveled by the general public and Hwy Supt is in favor of vacating the road; the letter is on file. Resolution to set public hearing was adopted. RESOLUTION No. #2026-08 - Setting Date and Time for Public Hearing To Vacate Public Road Number 203 (Co. Rd 44) WHEREAS, upon order by the Burt CO. Board of Supervisors and in accordance with section 39-1722 of the Nebraska Revised Statutes, Ann Chyka the Burt CO. Highway Superintendent has made a study of Public Road Number 203 (Co Rd 44) legally described as a tract of land being the West 33 feet of the Southeast 1/4 and the East 33 feet of the Southwest 1/4 of Section 11, Township 20 North, Range 11 East of the 6th P.M. Burt Co., Nebraska. AND WHEREAS, there are 3 property owners currently abutting the described road, all 3 parcels have current leases with Burt County Solar. One resident has two of the properties and the other has access via CO. Road 45. AND WHEREAS, based on these facts, use of this road serves no purpose as a road traveled by the general public. I am recommending the Public Road Number 203 be vacated, which means that the roads existence is terminated by direct action of public authorities and the land reverts back to the landowners. AND WHEREAS, this road was offered to Arizona Township which they chose to not assume jurisdiction and maintenance of Public Road Number 203 during a township meeting that was held on the 11th day of June 2026. NOW THEREFORE BE IT RESOLVED, by the Burt Co. Board of Supervisors that a public hearing be held to take comments from the public concerning the vacating all or part of this road, such hearing to be held on July 28, 2026 at 9:20 a.m. in the boardroom of the courthouse in Tekamah, Nebraska.
