City of Oakland Council Proceedings OCTOBER 20TH, 2025 Regular Council Meeting NOTICE IS HEREBY GIVEN, that a regular meeting of the Mayor and City Council of the City of Oakland, Nebraska, will be held at 7:00pm on Monday, October 20th, 2025, at the Municipal Building, 401 North Oakland Avenue in Oakland, Nebraska for the regular monthly meeting. Mayor Dan Jacobs started the meeting at 7:01 p.m. with Roll Call. Council President Nathan Anderson, Council Member Jeremiah Johansen, and Council Member Amy Denker-Rost were all in attendance. At 7:28pm after all discussions it Council President Anderson made a motion to approve the speakers to be placed on the NPPD poles on Main Street with the understanding that OWC would be responsible for repairs, installation cost-fees, and all subscriptions. At 7:14pm Council President Anderson made a motion to approve the Authorization of Bid for the Johnson Subdivision with JEO. Motion was seconded by Council Member Denker-Rost. All present Voting: Aye (Johansen, Anderson, Denker-Rost) - 3, Nay - 0. 4. After discussion, Council President Anderson made a motion to approve adding an additional amount to employee pay stubs to account for the monthly Medicare reimbursement, calculated using each employee’s previous year’s tax rate to determine the appropriate percentage. Council Member Johansen seconded the motion. All present Voting: Aye (Denker-Rost, Anderson, Johansen) - 3, Nay - 0. 5. At 7:55pm Council Member Johansen made a motion to approve Water Project No. D311703 Group C Maguire Iron Pay App # 5 in the amount of $127,575.43. Motion seconded by Council President Anderson. All present Voting: Aye (Johansen, Anderson, Denker-Rost) - 3, Nay - 0. 6. At 7:55pm Council Member Johansen made a motion to approve Water Project No. D311703 Group A &B Eriksen Pay App # 9 in the amount of $306,958.29. Motion was seconded by Council President Anderson. All present Voting: Aye (Johansen, Anderson, Denker-Rost) - 3, Nay - 0. 7. At 7:56pm Council President Anderson made a motion to approve MEMORANDUM OF AGREEMENT (HEREAFTER, “MOA”)AMONG THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY REGION 7, THE NEBRASKA DEPARTMENT OF WATER, ENERGY, AND ENVIRONMENT, THE NEBRASKA STATE HISTORIC PRESERVATION OFFICE, AND THE CITY OF OAKLAND, NEBRASKA, REGARDING THE WATER TOWER DEMOLITION AND MITIGATION PLAN. Motion as seconded by Council Member Denker-Rost. All present Voting: Aye (Denker-Rost, Anderson, Johansen) - 3, Nay - 0. 8. At 7:59pm after discussion Council President Anderson made a motion to approve City Attorney to be Matt Munderloh. Motion was seconded by Council Denker-Rost. All present Voting: Aye (Johansen, Anderson, Denker-Rost) - 3, Nay - 0. 9. At 8:15pm Mayor Jacobs read the third reading of Ordinance 763 "AN ORDINANCE OF THE CITY OF OAKLAND, NEBRASKA, AMENDING THE CITY’S ZONING ORDINANCE AND REGULATIONS TO PROHIBIT “CONEX” CONTAINERS WITHIN THE C1, C2, I1, R1, R2, and RL ZONING DISTRICTS WITHIN THE CORPORATE LIMITS OF THE CITY; PROVIDING ABATEMENT PROCEDURES AND FOR COSTS OF REMOVAL AND A PENALTY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE." After discussion, the Council insisted to have somewhere within the Ordinance has "prohibited without prior approval from the Planning Commission and City Council with the proper building permit, building plans, and any other items requested. Clerk Eisenmenger to bring draft to next couple of meetings. 10. At 8:25pm Council President Anderson made a motion to approve Resolution 2025-7 A RESOLUTION OF THE CITY OF OAKLAND, NEBRASKA, DIRECTING THE SALE OF CERTAIN REAL PROPERTY OWNED BY THE CITY LOCATED AT THE WEST 90’ OF THE NORTH 1/2 OF LOT 9, BLOCK 6, CITY OF OAKLAND, NEBRASKA; THE EAST 42’ OF THE NORTH 1/2 OF LOT 9 AND THE SOUTH 1/2 OF LOT 9 AND NORTH 1/2 OF LOT 10, BLOCK 6, CITY OF OAKLAND, NEBRASKA; AND THE SOUTH 1/2 OF LOT 10 AND NORTH 1/2 OF LOT 11, BLOCK 6, CITY OF OAKLAND, NEBRASKA; PROVIDING THE MANNER, TERMS, AND CONDITIONS OF SUCH SALE. . At 8:28pm Council President made a motion close public hearing and go into closed session for the Janitor position and Water / Wastewater Operator position. At 8:35pm Council President Anderson made a motion to close closed session and go into public hearing for the Janitor position and Water / Wastewater Operator position. At 8:36 p.m., Council Member Johansen made a motion to approve Stephen Mills as the new Water/Wastewater Operator employee at a rate of $21.00 per hour, with a $1.00 raise per certification earned. At 8:36pm Council Member Johansen made a motion to approve Alexander Smith as the new Janitor at the rate of $15.50 per hour. Motion seconded by Council Member Denker-Rost.
