VILLAGE OF DECATUR REGULAR BOARD MEETING October 12th, 2023 @ 5:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, AND DECATUR EXPRESS. The guests signing in were: Rashelle and Bill Rickers, Rod Nelson, Garret Johnson (Brickyard Consulting). The guest not signing was Kevin Kellogg. 1) REGULAR MEETING CALLED TO ORDER BY CHAIRMAN SIECKE Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-yes. Quorum Present-yes 2) EXCUSE BOARD MEMBERS NOT ATTENDING THE MEETING: Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-yes. 3) AGENDA AND MINUTES OF THE PREVIOUS MONTH'S MEETING RECEIVED: Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-yes. 4) APPROVAL AND/OR CORRECTION AND SUSPENDED READING OF THE PREVIOUS MONTH MINUTES. No Corrections. Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-yes. 5) REPORTS OF OFFICERS, BOARDS AND OR COMMITTEES: 1)Police: Monthly Report: 5 Traffic stops-1 arrest Calls for Service Dog Bite Theft Suspicious Vehicle Suspicious Activity Assists Decatur Rescue x2 Burt County Sheriff’s Office 1 Siecke stated that one of our part-time Police officers has left and went to Wisconsin, one has left and went to Dakota County. KC Bang has left the Sheriff’s office and is now the full-time Emergency Manager for Burt County. Troutman asked if he was still going to our Chief of Police? Siecke stated he is, but not sure how much time he can give us. Siecke also stated that the Sheriff’s office has been calling him and he has been handling calls for the Village. We still have three part-time officers. 2)Lights: Monthly Report A. No meters pulled. Siecke asked if anyone has any reports of street lights out. Kirschenman stated there is one out at the Green Lantern, that was broken when the tree was cut down. Troutman stated that the new replacement light just came in this week. 3) Water & Sewer: Monthly Report A) Water Loss Report. Siecke asked if the .35% water loss is accurate? Troutman stated according to the formula it is. Warren stated he has a water leak at his shop. He stated that every time that line is messed with, he gets a leak. Siecke stated that they will get it fixed. B) Layne has been here and fixed the pump, we are waiting for the new meter. Layne stated that the probes are going to need replaced. C) Bill & Rachelle Rickers-Sewer Main & Updates. Rickers came to the table to discuss the sewer line that has been replaced. Bill stated that they had sent an email with the questions they had and photos with their concerns. The Village did not receive that email. Rickers showed the photos to the board members. Bill stated he did not know how the company compacted what was trenched, he said he was certain they did not follow any ASDM backfill. Rickers’s concern is the undermining of their driveway. He stated the concrete is still intact, there is seven foot of his driveway that has nothing under it. If there were to be any heavy equipment or a camper to drive on it, it would likely collapse his driveway. He said he was not going to allow this to stand. His driveway is concrete. He also said that there is no way that they trenched an eight-foot deep, 200 feet long trench and covered it in one day and did it right. Siecke stated as of right now we are still working with the State for the final okay and permit. Siecke explained to everyone, that according to our electrician the pumps for the lift station are not explosion proof. The Clerk spoke with North Sioux City Holdings today about those pumps and they are checking with the company about those pumps. Siecke also explained that he had spoken with the maintenance person today, and they are going to be filling in the areas with dirt on second avenue. The Clerk gave Raschelle the new email address. Siecke stated that the Village will make this all right. There was much more discussion with other issues. D) Sewer Permit has been extended indefinitely. The draft copy was sent today to look over. 4) Parks: Monthly Report. A) September Income of $5,830.92. Warren stated the dock has been pulled, fish cleaning station is being taken out and the old shower house will be winterized on Monday October 16th. 5) Streets: Monthly Report: A) October Hwy Allocation-$8,361.00. B) No Sales Tax has been received yet for September. Siecke stated that the 8-inch pipe that was put in on West 8th Street seems to be working. Kirschenman asked if we were going to do any street projects for this new fiscal year. Siecke sated that we will probably not do any street work next year, due to all the work that was done this year, along with the sewer projects that were done. Kirschenman stated he spoke with the maintenance supervisor about back filling the areas of the streets that were done. Warren agreed. 6) Sears Center: Monthly Report A. New Fitness Equipment is here. 6) OLD BUSINESS: 1. Tree Trimming Bid-Beatty Tree Service. Tabled for another month. 2. Bid from Burt County Public Power for Replacing Pole at the Ball Field and Monthly Charge. Hightree and the Maintenance Supervisor looked at the lights on the poles at the ball field. There were 18 lights out. There was discussion about not doing anything with the ballfield at all due it not being used. Warren stated to have the pole fixed and wait on the lights. Siecke stated to have the pole fixed and then submit a grant to replace the lights. Troutman made a motion to have Burt County Public Power fix the pole that needs replaced for the amount of $4,044.00, plus $55.00 monthly fee plus any usage that is used. Warren seconded the motion. Roll Call: Hightree-yes, Siecke-yes, Kirschenman-no, Troutman-yes, Warren-yes. 3. Bid from Justice Fire for Inspections for City Hall and the Sears Center. The Clerk has not received the bid yet. Will table until next month. 4. Kubota UTV. Warren stated that there is a 2006 Diesel Kubota with heater, full cab, hydraulic blade for sale in Decatur. They are wanting $10,000.00 for it. This would be used for blading the sidewalks, spraying, and reading meters. The Board members want to offer $9,000.00 for the Kubota. Put on next month’s agenda. 7) NEW BUSINESS 1. Gilmore & Associates are Closing-need to Choose Another Engineering Firm. Dave and Keith Gilmore are retiring, and so they are closing their business. 2. Garrett Johnson-Brickyard Consulting out of Hooper, NE. Garrett came to the table to discuss being the Village Engineer. He worked for JEO previously, and decided to start his own company, he does a lot of his work in Omaha. The Board discussed the sewer project and the One-and-Six-Year Street Plan (for next year). Hightree made a motion to Appoint Garrett Johnson from Brickyard Consulting to be our Village Engineer. Troutman seconded the motion. Roll Call: Kirschenman-yes, Siecke-yes, Warren-yes, Hightree-yes, Troutman-yes. 3. Reimburse Joyce McCullock for her Health Insurance through her job until she is able to get on the Village Plan at Open Enrollment. Troutman made a motion to reimburse Joyce McCullock for her health insurance at $98.50 per month until open enrollment for the Village health insurance in June 2024. Hightree seconded the motion. Roll Call: Kirschenman-yes, Siecke-yes, Warren-yes, Troutman-yes, Hightree-yes. 4. Bid for Road to Lots 4-20 in Block 30. Siecke stated that right now we do not have the money for this. Tabled until spring. 5. Public Hearing on Conex Containers. Troutman made a motion to open the Public Hearing on the Conex Containers. Warren seconded the motion. Roll Call: Kirschenman-yes, Hightree-yes, Siecke-yes, Troutman-yes, Warren-yes. The Planning Commission had a Public Hearing on September 6, 2023. They voted to recommend to the Village Board to pass the Ordinance #10-2023. Siecke asked if we could limit the Conex Containers to just within the Village Limits? The Board was also questioning the Commercial properties, the wording “all trailers”, and removing the containers that are already established. There were no questions from the audience but there was discussion. Troutman and Warren stated that they are okay with not having them in Residential areas, but take the Commercial properties out of the Ordinance. Warren made a motion to close the Public Hearing. Troutman seconded the motion. Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Warren-yes, Troutman-yes. Siecke closed the Public Hearing. 6. Ordinance #10-2023-Conex Containers. Ordinance#10-2023 will be revisited at the November 9th meeting. 7. Public Hearing-One-and-Six-Year Street Plan. Troutman made a motion to open the Public Hearing on the One-and-Six Year Street Plan. Warren seconded the motion. Roll Call: Hightree-yes, Kirschenman-yes, Siecke-yes, Troutman-yes, Warren-yes. Siecke stated the One-and-Six Year Street Plan is normal maintenance. There are no major street plans for next year, due to all the work that was done this year. The 3rd Avenue and 13th Street project was completed this year. Siecke stated to Garrett Johnson that the Broadway Bridge is on the One-and-Six Year Street Plan. Garrett asked about the Missouri River Bridge, the Clerk showed Garret the file. Resolution 185-Allowing Chairman to Sign the Annual Certification of Program Compliance Form 2023. Chairman Siecke read the Resolution. Resolution #185 WHEREAS: State of Nebraska Statutes, sections, 39-2115, 39-2119, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classification and Standards; and WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body of the municipality authorizing the signing of the certification form. Be it Resolved that the Village Board Chairperson of Decatur is hereby authorized to sign the attached Municipal Annual Certification for Program Compliance form. Hightree made a motion to approve the Village Board Chairperson to sign the Municipal Annual Certification for Program Compliance form. Troutman seconded the motion. Resolution 186-Adopting the One-and-Six-Year Street Plan. VILLAGE OF DECATUR, NEBRASKA RESOLUTION #186 The following Resolution was introduced by Board Member Warren, who moved for its adoption, seconded by Board Member Hightree. WHEREAS, the Street Superintendent has prepared and presented a One-and-Six Year Street Improvements for the Village of Decatur, Nebraska, and: WHEREAS, a Public Hearing was held on October 12, 2023 to present this plan, and all objections and recommendations in said plan were considered; THEREFORE, be it resolved by the Village Board of Decatur, Nebraska, that the plan and data as furnished and/or revised are hereby in all things accepted and adopted. Upon Roll Call as follows; Kirschenman yes, Troutman-yes, Siecke-yes, Warren-yes, Hightree-yes. WHEREUPON, the Resolution was declared passed by the Village Board of Decatur on the 12th day of October, 2023, at Decatur, Nebraska.
