Minutes of the Burt County Board of Supervisors The Burt Co. Board of Supervisors met June 14, 2022 in the Co. Boardroom on the 2nd floor of the Burt Co. Courthouse in Tekamah, NE. Notice was given in the Lyons Mirror-Sun, on 1st floor bulletin board in courthouse and Co’s Website. A proof of publication is on file with Co Clerk. The following members were present: David Schold, Kevin P. Tobin, Gary “Bird” Swanson, Carl Pearson and Ted Connealy. Absent- Paul Richards and Dale Webster. The meeting opened at 9:00 A.M. with the pledge of Allegiance. Chairman Schold informed the public that the Open Meeting Act is posted on the wall. The agenda was approved… motion Connealy, Pearson. The 5/27/22 minutes were approved… motion Swanson, Pearson. May Reports, receipts and Fund Balances were all approved… motion Connealy, Tobin. Employee Handbook: The updated Employee Handbook (dated June 2022) was approved… motions Pearson and Connealy Public Hearing 9:20-9:23 a.m. for Burt Co. Zoning Regulations Section IV - DISTRICTS & INTERPRETATION OF DISTRICTS BOUNDARIES and Section V - CONDITIONAL USES, PROCEDURES AND STANDARDS; and b) Updates to Burt Co. Zoning Regulation Book -Section 6.01 Radio, Television, and Wireless Communication Tower Section: Resolution 2022-09 with Exhibit A was adopted… motions Connealy and Pearson. RESOLUTION #2022-09 - WHEREAS, on June 13th, 2022, the Planning Commission of Burt County, Nebraska did hold a public hearing for updates made to Articles IV- DISTRICTS & INTERPRETATION OF DISTRICTS BOUNDARIES and Section V - CONDITIONAL USES, PROCEDURES AND STANDARDS; and b) Updates to Burt County Zoning Regulation Book -Section 6.01 Radio, Television, and Wireless Communication Tower Section, in the Burt County Zoning Regulations. AND WHEREAS, the Burt County Board of Supervisors held a public hearing on June 14th, 2022 to consider the updates made to Articles IV- DISTRICTS & INTERPRETATION OF DISTRICTS BOUNDARIES and Section V - CONDITIONAL USES, PROCEDURES AND STANDARDS; and b) Updates to Burt County Zoning Regulation Book -Section 6.01 Radio, Television, and Wireless Communication Tower Section, in the Burt County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, by the Burt County Board of Supervisors that 1. The public hearing had advanced notice as required by Nebraska law and conformed with the Nebraska Opens Meeting Act, and Section 9.01-Amendments of the Burt County Zoning Regulations and, 2.Upon consideration of all matters presented to the Board, the Board of Supervisors did vote to amend the Burt County Zoning Regulations relating to Articles IV- DISTRICTS & INTERPRETATION OF DISTRICTS BOUNDARIES and Section V - CONDITIONAL USES, PROCEDURES AND STANDARDS; and b) Updates to Burt County Zoning Regulation Book -Section 6.01 Radio, Television, and Wireless Communication Tower Section, in the Burt County Zoning Regulations, and, 3. A copy of the amended regulation is attached hereto as Exhibit “A” and incorporated herein by reference, and, 4. This resolution shall be in full force and effect from and after its passage. FY 2022-23 Budget cycle: Designation of Vendor for LB644 Joint Hearing Postcard Printing… approved on motions Connealy, Tobin; designation of STATE PRINT SHOP as the vendor. Dates for Budget meetings and Protest Meetings were reviewed. Board of Equalization was held from 9:30 – 9:50 a.m. Burt Co. Visitors Committee: appointment of Scott Herbolsheimer to replace June Simpson on the committee… motions Swanson, Connealy. Courthouse Security: no action was taken. EM KC Bang presented security options and costs to the Board. Supervisor Tobin shared with the Board that T-H School Supt Dan Gross offered for a rep from the Co. Board to attend a July meeting he is going to have with the State DOT about relocation of the crosswalk on Highway 75 that currently runs between the School and Courthouse Properties. President Biden’s Executive Order 14008 – ‘30x30’ goal: No action was taken. ROADS – No action. the meeting adjourned at 11:14 A.M. upon motions by Connealy and Swanson. Chairman Schold informed the public that the Open Meeting Act was posted. Communication: TERC FINDINGS AND ORDER for 2022. Property Valuation Adjustment recommendations: Clerical Errors per §77-128 and Undervalued/Overvalued Property per §77-1315.01 were presented by Katie Hart, Burt Co. Assessor. (see full list in minutes online or in Co. Clerk’s office) The BOE reviewed, voted upon and approved the valuation changes… motion by Pearson and Swanson. Updated valuation notices will be sent out, and taxpayers will have thirty days to Protest the new values if they choose to do so.
