City of Oakland Council Proceedings JUNE 20TH 2022 On JUNE 20TH, 2022, the City Council of the City of Oakland, Nebraska, met on this day at 5:30 p.m. in Regular Meeting at the Municipal Building, 401 North Oakland Avenue in Oakland, Nebraska for the regular monthly meeting. Council members present, Mayor Ted Beckner, Council President Greg Mockenhaupt, Councilman Nathan Anderson, Councilman Luke Blanc, and Councilman Jeremiah Johansen were all in attendance. Also in attendance was Ortmeier , Ric Ortmeier CPA, Alyson Pedro, Channel 7 News Abbie Peterson ,Clerk Kayla Eisenmenger, 20 Citizens and 9 Employees. Believes there is an opportunity at the City Park to put in a 20 by 44 court and net , court can have a fence or not. The sport is played with two or four people Would like two courts, if possible , Councilman Luke Blanc was thinking of using the basketball court possibly at the City Park . Discussion of material / asphalt / fencing cost about $1,000 if start from scratch, more research would need to be done by council. Also questioned "Could City Auditorium be used as an option." There is no league per say - whomever comes - plays to the score of 11 and then the next team comes on, can get as organized as want. Questions of "Could it be set up to move from the basketball court and then in the winter in the auditorium?" Gene Poppe would be willing to help keep track / upkeep of the court. At 5:49 Brad Knipplemeier approached the Mayor and the Council about cost discount for long term campers who stay within the park. Currently it is $20 a night and for him personally it is about $3,000 per summer season to . Park/Rec Supervisor Brian Johnson talked to the City of Lyons who does $15.00 a day and then two days off if they stay seven days. The Mayor and Council mentioned they will look more into this. At 5:52 pm Citizen Ann Anderson approached the Mayor and Council about her emergency concern of the enter and exit of the area near Golf Link Drive. Mayor Beckner mentioned that since it is privately owned that there is not any requirements that the City can enforce since it is not a platted alley for the City. Fire Chief Nick Seery mentioned a fire hydrant is on the East side of the privately owned road. At 5:56 pm Ric Ortmeier, CPA and Alyson Pedro who is the City's third-party accountants approached the Mayor and Council with the suggestions of procedure update to be implemented within the City of Oakland NE. The suggestions are as read Accounts Payable: 1) Dollar amount limit to be approved BEFORE purchase 2) Fuel receipts signed by employee purchasing along with what piece of equipment or vehicle. Put numbers with each piece of equipment or vehicles 3) No cash advances, personal food or drink charged to the city accounts 4) All purchases need a receipt or invoice to clerk, or it will not get paid Payroll: 1) Electronic time clock for ALL employees 2) Board approval before payments is made Use of City Vehicles : 1) City owned vehicles should be used for city use only and kept on city property when not in use, amount of time to keep the timecards and hours - electronic . The City of Oakland to go into interlocal agreement with Lyons to keep better track of hours. There is no longer the use of gift cards for any departments. Discussion of payroll being approved PRIOR to the draft is ready to go - Could be by department Councilman or Mayor . Mayor Beckner mentioned Council would like to approve the move forward of the GWORKS module Councilman G. Mockenhaupt made motion approve the move forward of the GWORKS module. Councilman L. Blanc seconded the motion at 6:11p.m. All present Voting : Aye (Greg, Nathan ,Luke, Jeremiah,)- 4, Nay - 0. Suggestions to have a manual of the procedures are for each City Council members so they understand what their responsibilities in the future. Councilman J. Johansen mentioned that taking home of the city utility truck since he is a 24/7 employee. Park Supervisor BJ mentioned that their trucks are taken home at lunch time, all are in agreement that is understandable. Mayor Beckner mentioned State Auditor mentioned what we need to change - he asked Mr. Ortmeier and Mrs. Pedro "will this satisfy the State Auditor if we make these changes?" Mr. Ortmeier thinks it will. Mrs. Denise Gilliland questioned with the current situation; Citizen's tax dollars are being spent on Police Department what is being prioritized by the folks of the investigation? The Mayor and Council are waiting to for the investigation to be complete before decision to remove anyone. Mayor Beckner advised everyone that if discussion of the Chief of Police employment Mayor Beckner asked if anyone has asked Chief Terry Poland of his side of the story/experience. Citizen asked, "how can one approach the Chief and ask him while believing one word." Mayor Beckner asked if anyone has/had done their diligence on the situation before making decisions. Citizens asked, "is it inappropriate to approached ex-employee?" Also asked was the estimated amount of time that this investigation will take?" Citizens are curious to know what happens with all the stuff that he purchased; does it go back to Scheels? Council President G. Mockenhaupt mentioned that as a Council that if there is wrongdoing that it would be addressed. Mayor Beckner asked for community to come to him with any concerns or questions and to trust in the process , allow the people who are being investigated the ability to defend themselves. A citizen asked, "how long has the Council known about this " Mayor Beckner responded we all were given notice around late May 2022. DEPARTMENTS: At 6:40 pm Mayor Beckner thanked the employees for fixing the swimming pool and saving money while doing it during hot weather. Mayor Beckner mentioned they would like to have all the buildings/grounds/inventory to be kept painted ,mowed, cleaned, organized and vehicles cleaned. The citizens look to the City for leadership since we give ordinances/regulations/ requirements. Mayor Beckner mentioned to help police force know that there is a violation set an example for citizens. Employee made mentioned that there have been numerous times where they called Police to have help moving a vehicle or report an ordinance violation and there was no result in helping them. Mentioned about the timekeeping will be changing in the future to be willing to change with those new Implementations. To be open to suggest things that work better on a timecard keeping or anything city related. Councilmen mentioned that they appreciate them and their hard work in keeping things going as there is a lot of responsibility on the city employees with what they do. Employee made comment that having troubles with grass in the street and goes into the storm drainage which plugs them up. Mayor and Council made mention that it takes all of us to make the city work. POLICE: Fire Chief Nick Seery approached council at 6:32pm Reviewed the tornado sirens around town Locations are : 1) Evangelical Free Church : South of the Southwest corner of Church building 2) First Evangelical Lutheran Church : Southwest corner of Third and Charde Ave 3) Central Valley Ag: at the end of Third St. on the West side of the Railroad tracks 4) NPPD building : North of the building 5) City Park : East of Sewer Treatment Plant All five sirens working just fine , did one by one. All yellow multiple direction with a power box and a radio box to set off from remotely. The siren on Third and Charde is a rotational 360 Deg and may have battery backup. 2 months ago, a test was completed on these sirens by the company who services them. One June 4th, 2022, Mr. Seery listened to the sirens , after the test was completed by Burt County dispatch at 10:00 a.m. It lasted with a 3-minute cycle and was able to use his radio, set them off again and cancel them with the radio. run for 3-minute cycle . BUSINESS: At 7:13 p.m. Councilman G. Mockenhaupt made a motion to shelve "Resolution 2022-2 "Order to provide for a coordinated response to a disaster or emergency in Burt County, the City of Oakland and other cities and villages in Burt County, the Oakland City Council deems it advisable and in the best interest of the community and the County to approve the attached Burt County Local Emergency Operations Plan. Acceptance of this 2022 Local Emergency Operations Plan supersedes all previous approved Burt County Local Emergency Operations Plans". Motion was seconded by Councilman J. Johansen. All present Voting : Aye (Greg, Nathan ,Luke, Jeremiah,)- 4, Nay - 0. Councilman J. Johansen asked about the administrative leave with pay and the rules set forth why he is on administrative leave. Mayor Beckner informed Council that the Chief of Police #491 police car at is at garage of the PD. Discussed if there should be no communication with employees during his investigation. Should he have access for an employee to the police station as a citizen saw and heard he is in the police station when he was on leave. It was discussed that Police Chief Poland may need be occupied into the police station by Mayor or Councilman from now on. At 7:22 p.m. Councilman L. Blanc made a motion to approve the recommendation from building inspector Jeff Rennerfeldt to do "Inspection and Evaluation of Buildings and Property" on L6 & E38'L7 Lundstrom East Addition commonly known as 201 E. Fulton St Parcel #113205400 and L5 Lundstrom’s East Addition commonly known as 205 E. Fulton St, Parcel #11325500. Motion was seconded by Councilman N. Anderson. All present Voting : Aye (Greg, Nathan ,Luke, Jeremiah,)- 4, Nay - 0. At 7:24 p.m. Councilman N. Anderson made a motion to waive the three readings of Ordinance 741 " AN ORDINANCE OF THE CITY OF OAKLAND, NEBRASKA, AMENDING SECTION 5.12.02(74) OF ITS ZONING ORDINANCE (ORDINANCE NO. 567) TO PERMIT RESTAURANTS WITH DRIVE-THRUS AS A PERMITTED USE IN THE GENERAL COMMERCIAL (C-3) DISTRICT; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE." Motion was seconded by Councilman G. Mockenhaupt. All present Voting : Aye (Greg, Nathan ,Luke, Jeremiah,)- 4, Nay - 0. At 7:24 p.m. Councilman N. Anderson made a motion to approve Ordinance 741 " AN ORDINANCE OF THE CITY OF OAKLAND, NEBRASKA, AMENDING SECTION 5.12.02(74) OF ITS ZONING ORDINANCE (ORDINANCE NO. 567) TO PERMIT RESTAURANTS WITH DRIVE-THRUS AS A PERMITTED USE IN THE GENERAL COMMERCIAL (C-3) DISTRICT; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE." Motion was seconded by Councilman G. Mockenhaupt. All present Voting : Aye (Greg, Nathan ,Luke, Jeremiah,)- 4, Nay - 0. At 7:30 pm concerns about parking spots and taking away the value of the people to sell a place who has main ground level living. Council discussed options back and forth and concluded that this needs to be shelved. At 7:44pm Councilman J. Johansen made a motion to shelve Ordinance 742 "AN ORDINANCE OF THE CITY OF OAKLAND, NEBRASKA, AMENDING SECTION 5.11.03(3) OF ITS ZONING ORDINANCE (ORDINANCE NO. 567) TO PERMIT DWELLING UNITS ON THE SECOND STORY AND ABOVE ONLY AS A PERMITTED CONDITIONAL USE IN THE DOWNTOWN COMMERCIAL (C-2) DISTRICT; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE." Councilman L. Blanc seconded the motion. Councilman N. Anderson voted Nay. Councilman G. Mockenhaupt voted Nay. Mayor Beckner made a motion for a yay to approve Ordinance 742. However, with only one yay for approving the actual Ordinance and two yay for shelving and two yay for not shelving vote to approve Ordinance was not passed. Mayor Beckner made a motion to approve shelving of Ordinance 742 "AN ORDINANCE OF THE CITY OF OAKLAND, NEBRASKA, AMENDING SECTION 5.11.03(3) OF ITS ZONING ORDINANCE (ORDINANCE NO. 567) TO PERMIT DWELLING UNITS ON THE SECOND STORY AND ABOVE ONLY AS A PERMITTED CONDITIONAL USE IN THE DOWNTOWN COMMERCIAL (C-2) DISTRICT; REPEALING ALL ORDINANCES, RESOLUTIONS, CODE SECTIONS, AND PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE." All present Voting : Aye ( Ted, Luke, Jeremiah,)- 4, Nay - 2 (Greg, Nathan) Mayor informed council that a police officer will be leaving and would like permission to post for a police position. At 7:48 p.m. Councilman G. Mockenhaupt made a motion to approve posting for a new police officer. Motion was seconded by Councilman L. Blanc. All present Voting : Aye (Greg, Nathan ,Luke) - 3, Nay - 1 ( Jeremiah). At 8:05 p.m. Councilman N. Anderson made a motion to adjourn the meeting. Motion was seconded by Councilman G. Mockenhaupt.
